1. Introduction

This Acceptable Use Policy ("AUP") governs your use of the Windrush BOS platform (the "Platform"). This AUP is incorporated into and forms part of our Terms of Service.

By using the Platform, you agree to comply with this AUP. We may update this AUP from time to time, and your continued use of the Platform constitutes acceptance of any changes.

2. Prohibited Activities

You must not use the Platform to:

2.1 Illegal Activities

  1. Engage in any activity that violates any applicable local, state, national, or international law or regulation.
  2. Facilitate or promote illegal conduct, including fraud, money laundering, tax evasion, or any criminal offence.
  3. Infringe upon or misappropriate any third party's intellectual property rights, trade secrets, or proprietary information.

2.2 Harmful or Offensive Content

  1. Upload, transmit, or store content that is defamatory, obscene, abusive, threatening, harassing, or discriminatory.
  2. Upload content that contains graphic violence, exploitation, or material that promotes harm to any individual or group.
  3. Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity.

2.3 Spam and Unsolicited Communications

  1. Use the Platform to send unsolicited bulk emails, marketing messages, or spam through Platform features (e.g., invoice emails, quote emails).
  2. Use the Platform's email functionality to send communications to recipients who have not consented to receive them, except for legitimate business correspondence related to jobs, invoices, and quotes.

2.4 Malware and Security Threats

  1. Upload, transmit, or distribute any viruses, worms, trojans, ransomware, or other malicious software.
  2. Attempt to gain unauthorised access to any part of the Platform, other Accounts, or any systems or networks connected to the Platform.
  3. Conduct security testing, penetration testing, vulnerability scanning, or load testing against the Platform without prior written authorisation from Windrush BOS.

2.5 System Abuse

  1. Use the Platform in any manner that could disable, overburden, damage, or impair the Platform or interfere with any other party's use.
  2. Use automated scripts, bots, crawlers, scrapers, or similar tools to access or interact with the Platform beyond the intended user interface and documented APIs.
  3. Exceed reasonable usage limits or engage in activities designed to circumvent rate limits, quotas, or access controls.
  4. Attempt to access, modify, or delete data belonging to other tenants or Accounts.
  5. Use the Platform's AI estimation features to systematically extract or reverse-engineer our pricing models, algorithms, or training data.

2.6 Misuse of Platform Features

  1. Create multiple Accounts to circumvent Subscription limits, seat restrictions, or trial limitations.
  2. Share Account credentials with individuals not authorised under your Subscription.
  3. Use the Platform for purposes substantially unrelated to trade or construction job management (e.g., using it as a general file storage service).

3. Content Responsibility

  1. Your Content. You are solely responsible for all data, documents, photos, and other materials you upload to or create within the Platform ("Your Content").
  2. Accuracy. You are responsible for ensuring that Your Content is accurate and does not violate any third party's rights.
  3. Backups. While we maintain backups as described in our Privacy Policy, you are encouraged to maintain your own backups of critical data using the Platform's export features.
  4. Sensitive Data. You acknowledge that the Platform is designed for trade business management and is not intended for storing highly sensitive personal data beyond what is necessary for employment and job management purposes (e.g., do not store medical records, government identity numbers, or financial account passwords in the Platform).

4. Rate Limits and Fair Use

  1. The Platform may enforce rate limits on API calls, file uploads, AI estimation requests, and email sends to ensure fair and equitable access for all users.
  2. Specific rate limits are documented in the Platform's help resources and may vary by Subscription plan.
  3. If you consistently exceed fair use limits, we may contact you to discuss upgrading your plan or adjusting your usage patterns.
  4. Automated integrations should implement appropriate backoff and retry logic and must not exceed documented API rate limits.

5. Consequences of Violation

If we determine, at our sole discretion, that you have violated this AUP, we may take one or more of the following actions:

  1. Warning. Issue a written warning specifying the violation and requesting immediate remediation.
  2. Content Removal. Remove or disable access to content that violates this AUP.
  3. Feature Restriction. Temporarily restrict access to specific Platform features.
  4. Account Suspension. Temporarily suspend your Account. During suspension, you will not be able to access the Platform, but your data will be preserved.
  5. Account Termination. Permanently terminate your Account in accordance with the Terms of Service. You will be given a 30-day window to export your data unless the violation involves illegal activity, in which case immediate termination without a data export window may apply.
  6. Legal Action. Pursue any available legal remedies, including reporting violations to law enforcement authorities where appropriate.

The severity of the response will be proportionate to the nature and severity of the violation. We will generally attempt to provide notice and an opportunity to remedy non-critical violations before resorting to suspension or termination.

6. Reporting Violations

If you become aware of any violation of this AUP by another user or any security concern, please report it immediately:

  • Email: info@windrush.net.au
  • Subject line: "AUP Violation Report" or "Security Concern"

Please include:

  1. A description of the violation or concern;
  2. Any relevant evidence (screenshots, timestamps, URLs); and
  3. Your contact information for follow-up.

We will investigate all reports promptly and take appropriate action. We will not retaliate against users who report violations in good faith.

7. Monitoring

  1. We do not routinely monitor the content of individual Accounts.
  2. We may monitor aggregate usage patterns, system performance, and security events.
  3. We reserve the right to investigate any suspected violation of this AUP and to access Account data as necessary for the investigation, in compliance with our Privacy Policy and applicable law.
